Who these terms are between
These terms are between you and Kettle Lane Studio [legal entity to be confirmed once incorporation completes; until then the studio's founder trading as Kettle Lane Studio], referred to as "we" and "us". By downloading or using the Car Boot Scanner app ("the app") you agree to them.
The app is distributed through Apple's App Store. Apple's standard Licensed Application End User Licence Agreement also applies to your download, and Apple is not responsible for the app or for providing support for it. [Decide before submission whether to rely on Apple's standard EULA or a custom EULA; if custom, Apple's minimum terms must be included.]
Estimates are not valuations
The app identifies items from photographs and shows an estimated resale price range produced by an artificial intelligence model. The estimate is a general indication only. It is not a valuation, appraisal, authentication or financial, legal or tax advice, and it is not based on verified sold-price data.
Identification and estimates can be wrong, sometimes by a lot. Confidence levels are the model's own assessment and are not a guarantee. You are responsible for any decision to buy, sell, keep or price an item, and for checking current sold prices and the authenticity of anything valuable before you rely on it. We accept no responsibility for the outcome of those decisions, to the extent the law allows.
The app does not confirm whether an item is genuine, safe, legal to sell or free of defects.
Using the app
We grant you a personal, non-transferable licence to use the app on Apple devices you own or control, in line with these terms and Apple's usage rules. You must be at least 13 years old to use the app. [Confirm minimum age against the chosen App Store age rating.]
You agree not to:
- use the app to photograph people without their consent, or to identify or value items you do not have the right to handle;
- attempt to bypass the free scan allowance, rate limits or subscription checks, including by faking device identifiers;
- reverse engineer, scrape or bulk-query the app or our servers, or use them to build a competing dataset or service;
- upload content that is unlawful, or that infringes someone else's rights;
- use the app for anything that would breach UK law, including the sale of prohibited or counterfeit goods.
We may suspend or limit access for an install that breaks these rules or that places unreasonable load on the service.
Free scans and subscriptions
The app includes a small number of free scans per install (currently three). After that, scanning requires an active subscription. Saving, viewing and sharing scans you have already made does not require a subscription.
Subscriptions are sold and billed by Apple through your Apple ID. The price, the billing period, any free trial or introductory offer and the renewal terms are shown in the app and on the App Store before you confirm a purchase. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can cancel at any time in your Apple ID subscription settings, and the subscription remains active until the end of the paid period. We do not offer weekly plans and we do not use countdown timers or similar pressure tactics.
Refunds are handled by Apple under Apple's refund policy. We cannot issue refunds for App Store purchases directly. Your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 are not affected. [Confirm final prices, trial length and introductory offer in App Store Connect before launch. Check the UK subscription rules under the Digital Markets, Competition and Consumers Act, expected from 2027, before they take effect.]
Free scan allowances, prices and features may change for the future. Changes do not affect a period you have already paid for.
Your photos and results
You keep all rights in the photos you take. You give us permission to process them for the purpose of identifying the item and producing an estimate, as described in the privacy policy. We do not keep your photos and we do not use them to train any model.
Share cards you export are yours to post. They include our small brand mark and the word "Estimate", which should not be removed where the card is presented as coming from the app.
Third-party services
The app links to eBay UK's own website so that you can check sold prices. That site is operated by eBay under its own terms and we are not responsible for it. Selling tips refer to UK marketplaces whose fees change; the app shows the fee assumptions it uses and these may be out of date. Check the marketplace's current fees before selling.
Our responsibility to you
If we fail to use reasonable care and skill in providing the app, or the app is faulty, you have the remedies the law gives consumers of digital content, including repair, replacement or a price reduction where appropriate.
We are not liable for losses that were not foreseeable when you agreed to these terms, for business losses, or for losses arising from decisions you take based on an estimate, identification or selling tip. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under UK law.
The app depends on third-party services, including the AI provider and Apple's services. We aim for it to be available but we do not promise uninterrupted service, and we may change or withdraw features.
Ending the agreement
You can stop using the app at any time and delete it from your device. To remove server records for your install, use "Delete all my data" in Settings first. We may end the agreement if you break these terms. Sections about estimates, your content, liability and governing law continue to apply after it ends.
Governing law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland you may also rely on the mandatory consumer protections of your home nation and bring proceedings there. [Confirm the jurisdiction once the registered office is known.]
